SID lawsuit hearing Friday

A lawsuit over the expansion of the Special Improvement District (SID) could come to a head with a hearing scheduled for Friday.

Union County Assignment Judge Karen Cassidy is scheduled to hear motions in Friends of Rahway Business LLC v. City of Rahway on Friday at 9 a.m. Whether a decision is made at that time is unclear. It’s also unclear what impact the lawsuit has had on the Rahway Arts District‘s budget while the litigation continues. City Council in June adopted a $760,000 budget for the expanded SID while in previous years, the downtown SID generated a budget of about $140,000.

A group of property owners filed suit in January over the expanded Special Improvement District. There have been two case management sessions this summer and the two sides have filed briefs ahead of Friday’s hearing. The city officially responded to the SID lawsuit in the spring.

City Administrator Cherron Rountree said after a City Council meeting in August that she expects a resolution to the matter shortly but didn’t say whether that would come at the October hearing. William Michelson, who is representing Friends of Rahway Business, said there is a good chance that the judge may issue a ruling on Friday.
